DATE : JUNE 23, 2017 This is an application seeking withdrawal of remaining 50% of the amount of compensation which is already deposited by the appellant in this Court. This Court by order dated 10/10/2014 had permitted the respondent-claimant to withdraw 50% amount of compensation deposited by the appellant on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial) of this Court. Now after the lapse of three years therefrom considering the requirement of respondent No.1 and also having regard to the fact that in similar F.A. No.70 of 2015 arising out of the same award, the Court has permitted withdrawal of the entire amount of compensation, this application is allowed. Respondent No.1 is permitted to withdraw remaining 50% amount of compensation on furnishing usual undertaking. Civil Application is disposed of.
