Considering the observations of the Tribunal that on the date of the order the age of respondent no.1 would have been around 75 years and considering the defence raised by the appellant - Insurance Company the respondent no.1 is permitted to withdraw Rs.1,00,000/- from the amount deposited by the appellant. The balance amount shall be kept in fixed deposit in any nationalized bank initially for the period of three years to be renewed every year till the decision of the appeal. The execution of the impugned award against the appellant is stayed. The civil application is disposed of in the above terms. JUDGE Tambaskar.
