The only grievance of the petitioner as contended before this Court is that the Additional Commissioner was made to believe that Regular Civil Suit No.120/2008 is pending resulting into dismissal of appeal preferred by the petitioner so also eventual order in review. The counsel for the respondent has specifically invited attention of this Court at page No.166 of his appeal memo, more particularly paragraph No.8 therein, a positive statement finds place that "suit filed for specific performance of contract of the respondent is dismissed on 24/02/2016 and against which the substantial appeal is pending."

As such, no error can be noticed to the said order. Resultantly, the petition does not deserve any consideration under article 227 of the Constitution of India.

In view of the aforesaid, writ petition stands disposed of accordingly.
