JUNE 28, 2017 Learned counsel for the applicants submits that application Exh.-148 was moved by the prosecution at the behest of the learned Judge of the Court below. After making this submission when this Court asked a specific question to show it from the record, the learned counsel is unable to show the same. The submission of the learned counsel is contrary to the record. It was not expected from the counsel to make such a statement against a judicial officer.

The learned Judge of the Court below has correctly exercised his jurisdiction under Section 311 of the Cr. P. C. No case is made out for interference in the present matter. The application is therefore rejected. JUDGE kahale
