By this writ petition, the petitioner only seeks the protection of her services in view of the judgment of the Full Bench, reported in 2015(1) Mh.L.J. 457 (Arun Vishwanath Sonone Versus State of Maharashtra & Others). Shri Maldhure, the learned Assistant Government Pleader appearing on behalf of the respondent no.1-Scrutiny Committee, raises a preliminary objection to the tenability of the writ petition at the Nagpur Bench of the Bombay High Court. It is stated that the petitioner has only sought the protection of her services and the said relief is sought against the school that is located in Bhandup, Mumbai. It is stated that it would be necessary for the petitioner to file a writ petition at the Principal Seat.
Since we are inclined to uphold the preliminary objection raised on behalf of the respondent no.1, Shri Palshikar, the learned counsel for the petitioner, states that the petitioner would file appropriate proceedings at the Principal Seat and this Court may continue the interim relief granted on 04.07.2016 by one month.
The request made on behalf of the petitioner is just and reasonable. Hence, we dispose of the writ petition with liberty to the petitioner to file proceedings before the appropriate forum. The ad-interim relief granted on 04.07.2016 to continue for one month.
Order accordingly. No costs.
