DATE : 25.07.2016 By this writ petition, the petitioner has sought an extension of interim protection granted by the Presiding Officer, Debts Recovery Tribunal at the time of deciding the appeal filed by the petitioner under Section 21 of the Recovery of Debts Due to Banks and Financial Institutions Act, 1993.

Shri Siras, the learned Counsel for the petitioner states that at the relevant time when the writ petition was filed, the Debts Recovery Appellate Tribunal was not functioning at Mumbai in the absence of the Chairperson. It is stated that the circulation of the matter for grant of interim relief is granted by the Chairperson of the Debts Recovery Appellate Tribunal, Calcutta, who has charge of the Debts Recovery Appellate Tribunal, Mumbai, for 28.07.2016 at Calcutta.

Shri Kumar, the learned Counsel for the respondent - Bank states that no steps would be taken against the petitioner till 29.07.2016.

In view of the statements recorded herein above, it would not be necessary to proceed with the writ petition any longer. We dispose of the writ petition with no order as to costs. JUDGE JUDGE Wadkar
