In spite of keeping the matter back, none appears for petitioner.

This petition is for seeking directions to respondent No.1 to initiate action against respondent No.2 - Bank and respondent No.3, who is alleged to be involved in criminal activities and to initiate action as contemplated under the provisions of the Code of Criminal Procedure against the accused.

The prayers when considered appears to be totally vague, as no writ in prayers made as aforesaid can be issued.

Even otherwise, petition is repeatedly adjourned on the request of petitioner's counsel for satisfying the Court, if prayers made in the petition can be allowed.

Today, none is present in spite of

44WP 553.18 opportunity granted to petitioner to make out a case. In that view of the matter, we find that petitioner is not interested in prosecuting his claim. Petition is therefore, dismissed in default.
