It was a complainant'

s grievance that the applicant is a customer of Bank who has issued four cheques amounting to Rs. 29,98,3436/- without having sufficient balance at his credit. According to the prosecution, by joining hands with the Bank Authorities those cheques were got honored and accordingly, the applicant has dishonestly received the aforesaid amount. Hence, the crime.

During the pendancy of this application, the applicant shows his willingness to deposit entire amount. In accordance with the assurance, the applicant has deposited amount of Rs. 29,98,343/- in this Court. Having regard to the said fact, there is no need to have custodial interrogation. Already investigation is complete and charge-sheet has been filed. In case of further investigation, certain directions can be given. In view of that, following order:-

2 16aba600.21 (I) Application stands allowed and disposed of.

(II) Ad-interim order dated 09.09.2021 is hereby made absolute upon same terms and conditions. (III) Henceforth, the applicant shall attend concerned Police Station as and when called.

(IV) The amount deposited in this Court, be transferred to the account of the Trial Court for its disposal in his discretion according to law.
