Heard the learned Counsel for the parties.

The Petitioner has questioned the stipulation contained in the Government Resolution dated 24 August 2018, wherein the condition was laid down that the teachers must pass the 'Teachers Eligibility Test' prior to the stipulated date. 3.

Since, the Petitioner did not pass the test, the impugned communication was issued to the Petitioner on 6 January 2020, which the Petitioner has challenged by filing this petition in August 2021.

It is common ground that in the meanwhile, this stipulation was challenged in various petitions, and Division Bench (Aurangabad Bench) of this Court upheld the validity of the stipulation, and that the petitions are pending in the Hon'ble Supreme Court, where an order of 'status-quo' is passed. 5.

After the communication dated 6 January 2020, no order has been placed on record adverse to the Petitioner. Since, the Petitioner has not terminated from service, the Petitioner will be governed by the outcome of the proceedings pending before the Hon'ble Supreme Court.

In light thereof it is not necessary to entertain the Writ Petition and it is disposed of.
