DATED : JULY 9, 2019 The applicant herein has approached this Court apprehending arrest in respect of FIR dated 31/05/2019, whereby offence under Section 420 of the Indian Penal Code has been registered.

According to the complainant, she and the applicant herein were in touch with each other through matrimonial website Jeevansathi.com. It is the case of the applicant that the applicant through this interaction won her confidence and thereafter asked her to deposit certain amounts in his account, claiming that he needed help in the marriage. It is the case of the complainant that the applicant duped her financially and also gave her false promise of marriage. On this basis, on 20th June, 2019, this Court issued notice of this application for grant of anticipatory bail.

In response thereof, it has been pointed out on behalf of the non-applicant / State that investigation is still underway and that the material that has come on record during investigation indicates that not only did the applicant get certain amounts transferred from the complainant, but, about six months ago he performed marriage with another girl, without informing the complainant at all. It is further pointed out that the complainant and her family members had made bookings to come to Nagpur for marriage with the applicant. It is also found in the investigation that the marriage hall was also booked, but, eventually, the applicant did not marry the complainant, forcing her to approach the police with the aforesaid complaint, leading to registration of FIR.

In view of the above, this Court is of the opinion that considering the aforesaid facts and also because the investigation is still underway, no case is made out for grant of anticipatory bail. Hence, application is dismissed.
