The applicant is arrested on 23rd June, 2014 in connection with crime registered against 9 accused (including the applicant) for the offence punishable under Sections 302, 307, 120-B, 201, 143, 144, 148, 149 and 506 of the Indian Penal Code, Section 4/25 of the Arms Act, Section 135 of the Maharashtra Police Act and Section 3 of the Maharashtra Control of Organized Crimes Act.
The application is opposed on the ground that the applicant is a habitual offender and ample evidence is available with the investigating agency which shows involvement of the applicant in commission of crime. Though in paragraph No.6 of the reply / affidavit filed by the non-applicant it is stated that the statements of eye witnesses show that the applicant was standing outside
2 ba548.17 the hall, armed with sword, the learned A.P.P. has not pointed out any such statement from the charge-sheet. The learned Advocate for the applicant has pointed that co-accused Ganesh, co-accused Rohit and co-accused Dipak are released on bail as per the orders passed by this Court. It is pointed out that though the case of co-accused Ganesh stands on a slightly different footing, the accusations against co-accused Rohit, co-accused Dipak and the applicant are similar. The investigation is complete and charge-sheet is filed.
Considering the facts of the case, the following order is passed:
The applicant having been arrested in connection with Crime No.239/2014 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.50,000/- (Rs. Fifty Thousand) and furnishing two solvent sureties in the like amount.
Till the conclusion of trial, the applicant shall reside outside the limits of Nagpur district and shall not enter limits of Nagpur district except for attending the trial.
In case the applicant is required to come to Nagpur for any other reason he shall obtain prior permission of Special Court.
The applicant shall be released only after he gives the details of address where he will be residing and also his cellphone number to the Investigating Officer and also before the Special Court.
3 ba548.17 The applicant shall attend the trial before the Special Court on every date unless granted exemption by the Special Court.
