The appellant has deposited the amount as per the impugned order, therefore, ad-interim stay, granted by this Court on 29th September, 2011, shall continue till decision of the appeal.

Considering the facts of the case, respondent No.1 is permitted to withdraw the amount deposited by the appellant on filing undertaking before the Registrar (Judicial) of this Court to the effect that if at the time of hearing it is found that the respondent No.1 is not entitled for the amount withdrawn by him he shall re-deposit the amount with the Registry of this Court within stipulated time. The Civil Application is disposed of in the above terms.
