Heard Shri A.M. Ghare, learned counsel for the applicant/ petitioner, Shri N.S. Rao, learned AGP for respondent Nos. 1 to 3 and Mrs. M.R. Chandurkar, learned counsel for respondent No. 4.
The subsequent certification by the competent authority that the instrument / machinery used by the petitioner is not motor vehicle, is sought to be brought on record to urge that the demand of entry tax upon it under the provisions of the Maharashtra Tax on Entry of Motor Vehicles (Local Area) Act, 1987, is erroneous. Writ Petitions are yet to be admitted. We, therefore, allow applications for amendment. The necessary amendment be carried out within a period of one week. Liberty to the respondents to file additional reply/ affidavit, if any, within a further period of two weeks. JUDGE JUDGE *GS.
