The applicant is apprehending arrest in Crime 502/2020 registered with Police Station Ballarpur, Chandrapur for offence punishable under section 65(e), 83 of the Bombay Prohibition Act.

On 25.07.2020, on secret information, the contraband comprising liquor to be sold in prohibited area, worth Rs.9,00,000/- was seized and two persons were apprehended on the spot. The role of the applicant surfaced during investigation.

The applicant has criminal antecedents. He is already facing similar prosecution. Notably, even after the registration of the present FIR, he is implicated in a similar offence on 14.10.2020 vide Crime 661/2020.

There is more than ample material to link the applicant with the crime.

No discretion can be exercised in favour of the applicant.
