MARCH 16, 2017 By this writ petition, the petitioner has sought a declaration that the break in service of the petitioner between 01.11.2000 to 26.11.2001, should be regularized. Shri Sahare, the learned counsel for the petitioner, states that in view of the statement made in the affidavit-in-reply filed on behalf of the respondent no.1, the grievance of the petitioner would stand redressed. It is stated that it is recorded in the affidavit-in-reply filed on behalf of the respondent no.1 that the break in service for 1 year and 26 days would be condoned as extraordinary leave only for the purpose of grant of pensionary benefits. It is stated that though apart from the said benefit, the petitioner would not be entitled to any other benefit, the petitioner is satisfied as the break of 1 year and 26 days in his service is being condoned by the respondents for the purpose of grant of pensionary benefits.

wp4647.15.odt Since, the grievance of the petitioner stands redressed in view of the statement made in the affidavit-inreply filed on behalf of the respondent no.1, which would be binding on the respondent no.1, we dispose of the writ petition with no order as to costs.
