None appears for the petitioner. Heard Shri A.D.Sonak, A.G.P. for the respondent Nos.1 & 2. The petitioner is disqualified under Section 14(1) (j-1) of the Maharashtra Village Panchayats Act, 1958. The subordinate authorities have concurrently recorded findings of fact that the claim of the petitioner that the third child is not of the petitioner but of his bother Shrikrishna and Sharda (Shrikrishna's wife), cannot be accepted in view of the documentary evidence on record which shows that the third child is born to Vidya (wife of petitioner) and that Shrikrishna and Sharda are living separately and both of them have initiated legal proceedings against each other and Shriksishna has filed divorce petition against Sharda. The petitioner has not been able to show that the concurrent findings of fact recorded by the subordinate authorities suffer from any perversity. I see no reason to interfere with the impugned orders.
The petition is dismissed. No costs.
