The petitioner has challenged the interim order passed by the learned District Judge, rejecting the application filed by the petitioner praying for stay to the execution of the decree passed by the trial Court. The trial Court has granted decree for declaration that Shri Nanaji Vishwanath Gedam and after his death his legal heirs i.e. defendant Nos.2 to 5 in Regular Civil Suit No.119 of 2008 are the occupiers in the suit land i.e. Plot No.752 to the extent of 136 square meters and Plot No. 750 to the extent of 84 square meters situated at Ward No.5, Tahsil-Kuhi, District-Nagpur. The petitioner has not been able to point out the reason which necessitates the grant of stay to the decree for declaration. I find no infirmity in the impugned order. The petition is dismissed. No costs.
