Shri Saboo, learned Counsel for the appellant submits that as the sole appellant had expired, notice dated 29-3-2017 was issued to Surendra Raghunath Kadu informing him about pendency of the second appeal. Though this notice was served, there is no response from the legal heirs of the sole appellant. He states that he has no further instructions in the matter.

In view of death of the sole appellant, the appeal is disposed of as abated.
