Heard.

The petitioner was allotted work of construction of shopping complex on 12.9.2012 and according to the petitioner the site was not made available and, therefore, the work could not be executed. Now the Municipal Council has again issued tender notice dated 31.5.2019 in respect of the same work. Hence, this petition is filed challenging it on the ground that the petitioner has already allotted the said work but the site was not made available. The petitioner has an remedy to file a Civil Suit for breach of contract or shall be at liberty to submit his bid in response to the advertisement. We do not find any reason to entertain this petition. The writ petition is dismissed.
