Apprehending arrest in connection with crime registered for the offence punishable under section 420, 370, 342, 374, 324, 323, 504 of Indian Penal Code, the applicant has sought pre-arrest bail.
The crime is registered on the complaint of the informant that under the guise of private employment in Saudi Arabia, the applicant had sold the informant for consideration of Rs. 2 lacs.
The application is opposed on the ground that the custodial interrogation of applicant is necessary to unearth the truth and to find out whether other persons are also involved in the activities.
The applicant, woman, aged about 58 years, has stated that she is suffering from cancer and is required to take regular treatment at the Tata Memorial Hospital and J.J. Hospital, Mumbai. The applicant has
2 ABA428.7.2017 also stated that she is not involved in any other crime/offence.
Considering the facts of the case, the order passed by this Court on 21st June, 2017 granting protection to the applicant is confirmed.
The application is allowed accordingly.
