The non compliance of interim order passed in Writ Petition No. 2254 of 2018 is alleged in the present contempt petition.
Affidavit in reply is filed on behalf of the contemnor stating therein that vide letter dated 31/07/2018 the petitioner was intimated to join the services as Assistant Traffic Superintendent in another Depot of Nagpur Division in compliance of the order passed in writ petition. However the petitioner had not till that date joined the services. The said affidavit in reply is filed on 08/08/2018 and the copy of the same is served on the petitioner. However, till date petitioner has not controverted the said position and/or has not filed any counter to the same.
904 CP 158-2018.odt 2 The learned counsel representing the petitioner has filed civil application for withdrawal of vakalatnama stating that the conduct of the petitioner compelled the counsel to rethink about representing the petitioner in the instant petition and after issuing notice to the petitioner on his known address, the notice returned back stating that the petitioner had left the address.
Taking into consideration the affidavit in reply, the civil application filed on record as well as the fact that substantive writ petition is pending we deem it appropriate to dispose of the contempt petition. Accordingly contempt petition is disposed of.
CIVIL APPLICATION NO. _____/2020 Civil application filed on behalf of the advocates representing the petitioner is allowed as notice sent by register post to the petitioner on his last known address has returned back with remark 'Left'.
Civil application is disposed of.
