Heard.

The applicants are arrested on 7th March, 2017 in crime registered against them initially for the offence punishable under Sections 302, 365, 450 read with Section 34 of the Indian Penal Code, however, at the time of filing of the charge-sheet, the crime registered against the applicants is shown to be in respect of offence punishable under Sections 306, 365, 450 read with Section 34 of the Indian Penal Code. The crime is registered on the complaint of Urmila (wife of deceased) that the applicants forcibly took away her husband from the house of the complainant and her husband and after some time dropped him back and fled away. According to the investigating agency, the applicants demanded money

2 ba551.17 from the husband of the complainant which according to the applicants they had given as advance for working on brick kiln.

The investigation is complete and the chargesheet is filed on 3rd June, 2017. The applicants claim to be Labourers and have stated that they are not involved in any other offence / crime. The non-applicant has not been able to show that custody of the applicants is required for further investigation. Considering the facts of the case, the following order is passed:

The applicants having been arrested in Crime No.8/2017 registered by the non-applicant, they be released on bail on executing P.R. bond for Rs.25,000/- (Rs. Twenty Five Thousand) each and furnishing two solvent sureties in the like amount for each of the applicant.

The applicants shall attend the trial before the Sessions Court on every date unless granted exemption by the Sessions Court.

The application is allowed in the above terms. JUDGE Tambaskar.
