In the present matter, the order of the Grievance Committee, directing the Management to consider the representation of the respondent No.1 dated 13/02/2017 on merits for his appointment as Shikshan Sevak in Junior College run by the respondents, is under challenge. 3.

The learned counsel for the petitioners submits that the representation has already been rejected. There are no direction that the representation shall be allowed. Whereas, the order only says to consider the representation on its own merits, meaning thereby, if the management does not find it to be fit to allow, it can be rejected. Moreover, there is no direction to appoint the respondent as Shikshan Sevak.

In the circumstances, once the representation has already been rejected and against such rejection the respondent No.1 has preferred an appeal before the College Tribunal, this matter does not survive, and has become infructuous. Accordingly, it is disposed of. In the circumstances, there shall be no order as to costs.
