On 11.09.2015, this Court has issued notice on both proceedings.

Writ Petition No. 4295 of 2014 filed by the applicant was dismissed in default on 07.01.2015 as nobody appeared for him on two occasions when the matter was called out.

Shri Bhise, Advocate holding for Shri Dhande, learned counsel for the applicant/ petitioner invites attention to the fact that there is delay of 159 days in filing the application for restoration. He reads out the application for condonation of delay which is supported by personal affidavit of the learned counsel, who appears for the applicant. He informs that even today, the counsel is busy in attending the ailing father. Respondent Nos. 1 & 2 are already served and they have chosen not to appear.

As we find the reason just and sufficient and there is no malafides, we condone the delay. The office to register MCA.

2710cao1585.15 MCA ST. NO. 13396 OF 2015 After the MCA is registered, for the same reason, the order dated 07.01.2015 is recalled. Accordingly, Writ Petition No. 4295 of 2014 is restored back to file.
