DATED : DECEMBER 04, 2019 This is an application for staying effect, operation and execution of judgment and order and for suspension of conviction and for grant of bail. The applicant is convicted by the learned Additional Sessions Judge, Chandrapur on 22.05.2019 in Sessions Case No.114/2015 for an offence punishable under Section 307 of the Indian Penal Code and for that punishment was awarded to the applicant for sufferance of rigorous imprisonment for ten years and to pay fine amount of Rs.5,000/-. Similarly, he is convicted for the offence punishable under Section 450 of the Indian Penal Code and he was directed to suffer rigorous imprisonment for three years and to pay fine amount of Rs.1,000/-.

Heard Mr. Rajurkar, learned counsel for applicant and Mr. Ghodeswar, learned Additional Public Prosecutor for the non applicant-State. Also perused the relevant documents/evidence necessary for consideration of this application in detail.

When the Court was about to dismiss the application, Mr. Rajurkar, learned counsel for the applicant submits that he has instructions from the applicant to withdraw the present application.

The application is dismissed as withdrawn.

Since the application is withdrawn by the applicant, this Court is not supplementing reasons as to why the Court is dismissing the application.

CRIMINAL APPEAL NO.427 OF 2019 Registry is directed to prepare paper book and place appeal for hearing.
