DATE : October 06, 2018 Civil Application No.1291 of 2018 By this application it is prayed that the compromise entered into between the parties be recorded under provisions of Order XXIII Rule 3 of the Code of Civil Procedure, 1908. The terms of compromise have been mentioned in paragraph 4 of the Civil Application. The application is supported by affidavits of all the signatories to the compromise. None of the parties have any objection to said compromise entered into. In view of aforesaid the Second Appeal is disposed of in terms of compromise as recorded in paragraph 4 of the Civil Application. The decree as passed in R.C.S. No.278/2000 and confirmed in R.C.A. No.23/2011 shall be substituted by the terms of the compromise as recorded in paragraph 4 of the Civil Application. The decree be drawn accordingly.
Similarly, the decree as passed in R.C.S. No.50/2012 dated 23/11/2015 is also substituted by the
912-SA-361-17 2/2 compromise as referred to herein above. As a result of this compromise the proceedings in R.C.A. Nos.3/2016 and 99/2016 stand disposed of. Copy of this order be placed in the aforesaid two appeals. Order accordingly. Civil Application and the Second Appeal stand disposed of in aforesaid terms. No order as to costs.
