CORAM : R.K. DESHPANDE & VINAY JOSHI, JJ.

JANUARY 08, 2019.

Heard Shri R.D. Wakode, learned counsel for the petitioners, Shri Sunil Manohar, learned Senior Advocate with Ms. N.P. Mehta, AGP for respondent Nos. 1 to 4. The grievance is in respect of failure on the part of the State Government to issue final Notification under Section 4 of the Maharashtra Land Revenue Code, 1966, for shifting of headquarters of Tahsil office of Bhatkuli from Amravati to Bhatkuli. Paragraph 8 of the reply filed by the State Government reads as under :

"8.

It is most respectfully submitted that, as per provision of section 4 of the Maharashtra Land Revenue Code, 1966, the State Government has already published Notification inviting objections and suggestions regarding shifting of Headquarters of Bhatkuli Tahsil to Bhatkuli.

The Government would like to apply its mind and take final decision regarding notifying the headquarters of Bhatkuli Tahsil, pursuant to the

0801wp3911.17 Notification dated 31.08.2009.

Till then, the Government is willing to keep the impugned directions dated 15.06.2017 in abeyance. It is, therefore, prayed that the order of status quo may kindly be vacated so as to enable the State Government to proceed further in this case as submitted above."

In view of the aforesaid stand taken by the State Government, the grievance of the petitioners does not survive. Writ Petition stands dismissed accordingly. No order as to costs.
