The learned A.G.P. has pointed out that as per the order passed by this Court on 16th July, 2015, nomination paper of the petitioner was accepted and she was allowed to contest the election but results were not declared. This Court passed order on 2nd September, 2015 as follows: "Put up on 09.09.2015.
In the meantime, the respondents are directed to declare the results of the elections. If it is found that the petitioner has secured highest votes, her result shall be ignored and the candidate below her shall be declared elected. The further process of election shall go on."
It is submitted that the counting was undertaken and the petitioner could not secure highest number of votes and therefore, the other candidate who secured highest number of votes is declared elected.

In view of the above, I find that the petition has become infructuous. Hence, it is dismissed accordingly. In the circumstances, the parties to bear their own costs. JUDGE RRaut..
