Respondent No.1 expired on 24th September, 2020. His death certificate is not disputed by respondent No.2-Anil Balpande who is son. His other legal representatives are not on record. The details are given in paragraph 2 of the said application. The application is filed in time. Hence, the order:-

1. The application is allowed.

2.The name of respondent No.1-Jagorao Bajirao Balpande be deleted and the names of his legal representatives be added.

3. The civil application is disposed of.

Second Appeal No.78/2005 Learned Advocate for respondent No.2 seeks some time to file vakalatnama on behalf of the legal representatives. In view of that, notice need not be issued.

Matter be kept on 4th October, 2021.
