Shri B.G. Kulkarni, Advocate for respondent no.2. --------- CORAM : B.P. DHARMADHIKARI AND KUM. INDIRA JAIN, JJ.

DATED : JULY 21, 2016 Heard for some time.

During hearing, our attention is invited to the fact that the Committee sent by respondent no.2 University has inspected the College of petitioner and submitted inspection report on 16/7/2016.

Adv. Chitaley for petitioner, upon instructions, states that without prejudice to contentions raised in the petition, all efforts will be made to remove those deficiencies within next four months. He further adds that inspection to find out compliance should thereafter be conducted within reasonable time so that petitioner can, in that event, admit students at least from next academic year, i.e.

2/3 2017-18.

Adv. Kulkarni appearing for respondent no.2 upon instructions states that if compliance report is submitted within a period of four months from today, respondent no.2 University shall complete necessary formalities for consideration of grant of first time affiliation within next two months. In view of this position, we direct petitioner to submit necessary compliance by 30/11/2016. Respondent no.2 University shall thereafter again appoint an Inspection Committee and that Committee after conducting inspection, submit a report to the University at the earliest. Respondent no.2 University shall within next two months, i.e. by the end of January 2017 consider eligibility of petitioner for extending to it first time affiliation. With these directions and keeping all rival contentions open, we dispose of writ petition. No costs.
