The case of the applicant is that only on the basis of the circumstantial evidence he has been impleaded as accused. It is submitted that the co-accused from whom it is alleged that, the applicant has received amount of Rs.50,000/- for contract killing, this Court granted bail to him observing that there is no material that amount of Rs.50,000/- was paid by him to the applicant. He further submits that out of seven accused, three accused have released on bail.

The case of the applicant cannot be equated with the other accused who have been released on bail, for the simple reason that, as against the applicant there is ample incriminating material available on record including the transcription of the conversation between the applicant and one co-accused Prem Talwekar.

In that view of the matter, looking to the offence which is serious one, I do not find any reason to release the applicant on bail. Accordingly, the application is rejected. (ANIL S. KILOR, J.) NSN
