DATED : 30/08/2019 After the learned advocates for the petitioner as well as respondent made submissions, it transpired that dispute relating to custody of the son of the petitioner and respondent who is now aged about 15 years, cannot be resolved in these proceedings under Article 215 of the Constitution of India read with Section 12 of the Contempt of Courts Act. Hence, on instructions from the petitioner who is present in the Court, learned advocate for the petitioner sought permission to withdraw the contempt petition. However, it is requested that the Family Court be directed to expeditiously decide the petition for custody of the child. The contempt petition is disposed as not pressed. The Family Court is directed to decide the custody proceedings till 15/01/2020. Looking to the nature of dispute and the age of child whose custody is sought by the petitioner
2 cp184.19 (mother), the Family Court is requested to examine the whether directions should be issued to keep the child - Aryan Preet present before the Family Court on all the dates. The Family Court may also pass appropriate orders to facilitate implementation of the order passed by it on 05/03/2019. JUDGE Ansari
