The petitioners are being threatened of coercive action against them for their failure to pay the difference in the amount of tuition fees.

In such cases, in another petition, being Writ Petition No.1901/2021, we have granted limited interim relief to the petitioners - students. We are of the view that the present petitioners being similarly situated, would also deserve similar benefit.

Accordingly, we direct that no coercive action be taken against the petitioners, who are studying in different years of the medical courses offered by the Government Medical College and Indira Gandhi Medical

caw1378.2021.odt College, Nagpur, subject to the condition that each of the petitioners shall give an undertaking to this Court that in case this petition is decided against them, and the petitioners are found liable to pay difference of the fees, the petitioners shall pay the same to the college authorities, within a period of four weeks from the date of final decision in this petition.

These undertakings shall be submitted by the petitioners within a period of one week to the Registrar (Judicial) of this Court, who shall then place them on record of this petition for appropriate consideration. 6.

If no such undertakings are furnished to this Court, within the time given by this Court, it will lead to vacation of the interim relief so granted under this order, without any reference to this Court.

Civil application is disposed of accordingly. No costs.
