IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR CONTEMPT PETITION NO.239 OF 2015 IN WRIT PETITION NO.451 OF 2015 (Shri Pradeep Eknathrao Gaikwad vs. Dr. Vinayak Irpate and another) ______________________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.
Shri P.N. Shende, Advocate for petitioner.
Shri B.G. Kulkarni, Advocate for respondents. -------- CORAM : SMT. VASANTI A NAIK AND KUM. INDIRA JAIN, JJ.
DATED : SEPTEMBER 28, 2016 By this contempt petition, the petitioner seeks action against the respondents for non-compliance of the order dated 17/8/2015.
According to the petitioner, though this Court had directed the Grievance Committee to decide the appeal of the petitioner as early as possible after the Grievance Committee is constituted, the appeal is not decided as yet.
Shri Kulkarni, the learned Counsel for the respondents, states on instructions that after the Grievance Committee was constituted, the Grievance Committee issued notice to the concerned parties for hearing of the appeal on 8/10/2016. It is stated that if the parties remain present on 8/10/2016, the appeal could be decided by 10/10/2016. It is stated that if in any case the appeal is not heard on 8/10/2016, the Grievance Committee would hear the appeal on the next
2/3 date on which the Grievance Committee would be constituted and the appeal would be decided.
Since we had not directed the Grievance Committee to decide the appeal within a time frame, we accept the statements made on behalf of the respondents, which would be binding on them and dispose of the contempt petition with no order as to costs.
