Notice on the application is made returnable forthwith. Learned counsel Shri R.L. Alone waives notice for the nonapplicants. Prayer is to condone the delay in seeking restoration of the appeal which was dismissed for want of prosecution. In the application, it was stated that on account of the absence of the applicant's counsel the appeal came to be dismissed. The absence of the counsel is not deliberate and hence it is prayed that the delay be condoned.

The prayer is opposed by the learned counsel for the non-applicants on the ground that the applicant was not diligent in prosecuting the appeal. The amount of compensation has also not been deposited by the applicant. Hence, there is no reason to condone the delay.

Considering the fact that the appeal has been dismissed for want of applicant's counsel, the applicant cannot be made to suffer. Hence, accepting the reasons mentioned, the delay in filing the restoration application is condoned. The civil application is allowed and disposed of.
