DATE : October 03, 2017 By these applications the State had prayed for cancelling the bail that was granted to the nonapplicants herein in connection with Crime No.11/2016. The principal ground on which cancellation of bail was sought was that the mandatory procedure as prescribed under the Maharashtra Control of Organized Crimes Act, 1999 before grant of bail had not been followed. Today Shri T. A. Mirza, learned Addl. Public Prosecutor submits that charge-sheet has been filed in the aforesaid crime. In the said charge-sheet there is no reference to any offence under provisions of the said Act

23-APPLN-30-16 2/2 of 1999. He has also referred to the communication dated 18/07/2016 in that regard addressed to the learned Public Prosecutor.

In view of aforesaid as the ground on which the bail was sought to be cancelled does not survive, the applications stand disposed of as having been rendered infructuous.
