DATE :- JULY 18, 2022 In this writ petition, the petitioner who is a retired employee of the Municipal Council, Ramtek seeking release of his retiral benefits. In the reply filed on behalf of the Municipal Council, Ramtek, it has been stated that on account of huge monthly expenditure and due to pandemic situation it has not been possible for the Municipal Council to pay the retiral dues of the petitioner. Time of one year has been sought to make the entire payment.

Shri S.A.Sahu, learned counsel for the respondent submits that some payment has been made to the petitioner in the last week of June, 2022.

We find that the petitioner having been retired after rendering service, he is entitled to receive retiral benefits. Hence by directing the Municipal Council to clear the dues of the petitioner by 31st March, 2023, the writ petition is disposed of. No costs. It is made clear that if the dues are not paid to the petitioner by that date, the Court could thereafter consider imposition of interest on the outstanding dues, if the occasion arises.
