By this writ petition, the petitioners i.e.

original plaintiffs have challenged order dated 29.10.2020, whereby the respondents i.e. defendants were granted permission to file written statement. 2.

The case of the petitioners is that admittedly written statement was not filed within the prescribed period of time and that there was delay of almost one year. It is submitted that in such a situation, the respondents ought not to have been granted permission to file the written statement. 3.

A perusal of the impugned order shows that the Court below took into consideration Prity

2 / 2 917.wp5330.2021 sequence such events including lock-down that had to be imposed due to Covid-19 Pandemic. It was specifically recorded that for about seven months the Court concerned itself was not working regularly and that in such circumstances, there was delay in placing written statement on record. On this basis, permission was granted, in the interest of justice. 4.

This Court is convinced that the reason stated in the impugned order is justified and that therefore, no interference is warranted in the impugned order.

Accordingly, the writ petition is dismissed.
