It is noticed from order dated 12th December 2015 that the parties have amicably settled the dispute before the National Lok Adalat and on compromise, the claim is settled at Rs. 3,50,000/-. The appellant-Insurance Company has deposited an amount of Rs. 6,00,378/- pursuant to the order of this Court dated 17.8.2015 and has made mandatory deposit of Rs. 25,000/- deposited on 13.7.2015. In view of the settlement by and between the parties, appellantInsurance Company is claiming refund of Rs. 2,75,337/-. Learned counsel for the respondents-claimants does not dispute the above position.

In view of the undisputed position, civil application is allowed in terms of prayer contained therein. JUDGE joshi
