Since this court was not inclined to grant anticipatory bail to applicant 1 - Abhishek Pradeep Jaiswal, the learned counsel Shri Patil, on instructions, seeks leave to withdraw the application unconditionally.
Anticipatory bail application, in so far as Abhishek Jaiswal is concerned, is disposed of as withdrawn unconditionally.
In so far as applicants 2 to 5 are concerned, I do not see any impediment in granting anticipatory bail. Applicants 2 and 3 are the father-in-law and mother-in-law of the complainant. The applicant 5 Sau. Nikita w/o Anupam Jaiswal is the sister-in-law of the complainant while applicant 4 Dr. Anupam Kamalnarayan Jaiswal is the husband of applicant 5 Sau. Nikita Anumpam Jaiswal. It would not be appropriate to evaluate the material on record minutely. Suffice it to say that in so far
aba414.18.O.odt 2 as applicants 4 and 5 are concerned the case of the prosecution appears to be that some gold belonging to the complainant was demanded to enable applicants 4 and 5 to construct hospital at Pune. The accusation against the applicants 2 and 3, the father-in-law and mother-in-law of the complainant are general in nature and in any event their custodial interrogation is not necessary. The application is partly allowed.
The application of Abhishek Jaiswal is disposed of as withdrawn unconditionally.
In so far as applicants 2 to 5 are concerned, the application is allowed and in the event of their arrest they be released on personal bond of Rs.15,000/- each with a solvent surety of the like amount.
The applicants 2 to 5 shall report at Police Station Gadge Nagar, Amravati as and when called upon to do so by the Investigating Officer and shall co-operate with the Investigating Officer.
The applicants 2 to 5 shall not tamper with the evidence nor shall attempt to influence the witnesses in any manner.
