Notice was issued in this application wherein the applicant/appellant (original claimant) is seeking enhancement of compensation by way of the accompanying appeal. There is a delay of 314 days in filing the accompanying appeal. Notice was issued in this application as well as appeal on 20.08.2019. The respondents have been served and they are represented by Mrs. Mrunal Naik, learned AGP. 2.

Insofar as the application for condonation of delay is concerned, it is specifically stated on behalf of the applicants that they could not approach this Court within the period of limitation due to financial constraints and also because of the fact that the enhanced compensation granted by the Reference Court was yet not disbursed in their favour.

Hence, for the reasons stated in the application, the same is allowed and the delay is condoned.
