Challenge in the present writ petition is to the notification dated 09/08/2001 issued under Section 4 of the Land Acquisition Act, 1894. This Court admitted the writ petition on 28/11/2003 but did not pass any interim order. Shri N. S. Khubalkar, learned Assistant Government Pleader for the respondents, on instructions, submits that on 29/09/2006 the respondent No.4 issued a communication informing that the notification under Section 4 has lapsed. In view of aforesaid, the challenge raised in the writ petition is rendered infructuous. Writ petition is accordingly disposed of with no order as to costs.
