The application is for grant of bail.

After hearing the learned Counsel for the applicant to some extent and after going through the investigation papers, a six years girl was subjected for sexual assault by the present applicant and considering the gravity of the offence, I have shown my disinclination to grant bail. Hence, the learned Counsel for the applicant seeks permission to withdraw the application with liberty to file after six months, if there is no progress in the trial. 3.

Considering the pendency before the learned trial Court, liberty is granted after one year if the trial is not commenced within one year.
