This Court vide order dated 5th April, 2016 passed in Writ Petition No. 74 of 2013 allowed the Civil Application No. 21 of 2015 seeking direction from this Court to the respondents to absorb the petitioner on the post of Labour, in view of the Government Resolution dated 16th October, 2012. In pursuance to the same, the petitioner was absorbed. However, he gave up the backwages by submitting an undertaking in writing.

The present contempt petition came to be filed alleging that the notional benefits i.e. increments were not granted to the petitioner from the date of Government Resolution dated 16th October, 2012. 4.

Learned Additional Government Pleader submits that there are no directions to grant such notional benefits. However, the authorities may consider the request, if any representation or application is made by the petitioner.

In that view of the matter, the contempt petition is disposed of with liberty to the petitioner to apply the concerned authorities for grant of notional benefits for which the petitioner is entitled for as per the Government Resolution dated 16th October, 2012. 6.

If such representation/application is moved by the petitioner, the respondent nos. 1 and 2 are directed to take necessary steps and to decide the same in accordance with the law.

The contempt petition is disposed of.
