Heard.

The applicant, apprehending arrest in crime registered against him and 7 others (all members of family of the applicant) for the offence punishable under Section 498-A read with Section 34 of the Indian Penal Code, has sought pre-arrest bail. The accusations against the applicant are that on 2nd May, 2017 the applicant and his mother had beaten the victim and taken away all her ornaments and forced her to leave the matrimonial house.

The learned advocate for the applicant has submitted that the marriage between the applicant and the victim was solemnized on 19th February, 2010 and till lodging of the F.I.R. on 2nd June, 2017 there had been no complaint of any such nature by the victim against the applicant. The applicant claims that he is in government service and is not involved in any other crime/ offence. Other seven accused are granted pre-arrest bail by the Sessions

2 aba444.17 Court. The applicant was also granted interim protection by the Sessions Court and till rejection of the application by the Sessions Court there has not been any complaint by the Investigating Officer that the applicant is not co-operating with it.

Considering the facts on record, following order is passed :

In the event of arrest in Crime No.257/2017, registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Twenty Thousand. The application is allowed in the above terms. JUDGE RRaut..
