In the present matter, the Industrial Court as well as Labour Court while adjudicating the grievance raised by the petitioner as regards his termination from the post of "Driver" of the respondent No.2 - Principal, Narayan Vidyalayam have held that the remedy lies before the School Tribunal.

In that view of the matter, the petitioner seeks permission to withdraw the present petition and file an appeal before the School Tribunal. Accordingly, permission to withdraw the present writ petition is granted with liberty to file appeal before the School Tribunal.

Writ Petition is disposed of as withdrawn with liberty as prayed for.

If such appeal is filed within four weeks from today, the School Tribunal shall consider the time period exhausted in pursuing the present writ petition, while deciding the issue of limitation.
