DATE : AUGUST 23, 2022 According to the petitioner, his father was the owner of the field bearing Gat No.65 admeasuring 11 H 43 R. In the present proceedings, the subject-matter is the land admeasuring 2 H 2 R. The said land came to be acquired and on 25-5-2021, Award was passed by the Land Acquisition Officer. The petitioner's father is stated to have expired on 1-8-2016 and when the petitioner made enquiry, it was noticed that the said land was standing in the name of one Shrikrushna Tukaram Jamode. The petitioner has thus raised an objection to the disbursement of the compensation to the said person.
In the petition, it has been stated that on enquiry it is found that the said Shrikrushna Tukaram Jamode is claiming right over the land in question in view of the sale-deed dated 14-1-1988. In the aforesaid facts, unless the said sale-deed is challenged by the petitioner, no purpose would be served by directing the Land Acquisition Officer to consider the petitioner' s representation/objection dated 25-8-2021.
At this stage, the learned counsel for the petitioner seeks leave to withdraw the writ petition with liberty to take such other steps as are permissible in law for seeking redressal of his grievances.
