The applicant, apprehending arrest in crime registered against him for the offences punishable under Sections 406, 408, 409, 468 and 471 of the Indian Penal Code, has sought pre-arrest bail. The crime is registered against the applicant on the complaint lodged by the Auditor, that while discharging his duties as Secretary of Suryadev Kamgar Sahakari Sanstha, Raipur, during the period 2011 to 2014, the applicant has misappropriated huge amount. Crime No.35 of 2017 is registered by the Police Station Chikhaldara against the applicant for similar offence on similar accusations relating to another Society. I have passed an order today allowing the Criminal Application (ABA) No.89 of 2017 filed by the applicant seeking pre-arrest bail.

In the present case also, none of the office bearer

2 aba446.17 of the society is shown as accused. The non-applicant has not been able to show that the custody of the applicant is required for further investigation.

Hence, the following order :

In the event of arrest in crime No.0099 of 2017 registered by the non-applicant, the applicant be released on bail on furnishing cash security of Rs.50,000/- and two solvent sureties in the like amount.

The application is allowed in the above terms. JUDGE PBP
