Heard Shri N.R. Mankar, learned Counsel appointed for the petitioner and Ms. N. Tripathi, learned A.P.P. for respondents.

Learned counsel for petitioner states that only reason for denial of furlough is late returning after he was released in 2011.

Learned A.P.P. points out that he was required to be arrested and brought back. He has been brought back after 917 days, and offence under Section 224 of Indian Penal Code has been

Learned counsel for petitioner states that as per the application sent to this Court by the prisoner, it appears that his remission has been cut for 5 days for each day of late reporting. Thus prima facie, remission cut appears to be for about 4585 days.

The prisoner appears to be under wrong impression and has not challenged the order of punishment/remission cut. In this situation, no case is made out warranting interference. Writ Petition is accordingly disposed of. No costs.

Fees payable to the learned counsel appointed for the petitioner is quantified at Rs. 1500/-.
