This is an application filed by the applicant under Section 11(6) of the Arbitration and Conciliation Act, 1966, for appointment of Arbitrator.

In view of clause (12) of the agreement dated 13th March, 2000 between the applicant and nonapplicant, a communication was made on 13th December, 2022 by the applicant for appointment of Arbitrator.

On failure of appointment of Arbitrator, present application came to be filed.

The learned counsel for the applicant and learned counsel for the non-applicant, on oral SKNair

50-mca-648-23.odt instructions, have agreed upon the name of sole Arbitrator and submits that Hon'ble Shri A.P. Deshpande, retired High Court Judge be appointed as sole Arbitrator.

Accordingly, the Registry is directed to issue a letter of request to Hon'ble Shri A.P. Deshpande, retired High Court Judge requesting him to consent to the appointment and to further submit the statement of disclosure, within two weeks from today.

Civil application is disposed of.
